Also recently fannie mae announced that they would no longer delay foreclosure sales for any reason, no exceptions. It is expected that Freddie will follow suite and other lenders.

I would certainly try that however i think there is a loophole that allows them to continue and collect the house. The other thing is that technically while they are evaluating a buyer to see if they might be eligable for HAFA they can't foreclose. However there is a good chance they would simply reject a HAFA application. You could always look up a bunch of bank execs and send an impassioned letter asking them to handle this. I don't have as much experience getting these things delaying in trustee sale situations as I work in a judicial foreclosure state. You are certainly more up to the mercy of the lender in this situation. The other possibility would be bankruptcy which would certainly stop it. If you client was considering it now would be the time.

Andy i am a Realtor in california. i am currently at a lost right now as to what to do. I picked up a listing but it came with a foreclosure sale date which is only two weeks away. I contacted the lender and they will not postpone the sale date even if i produce a good purchase offer. What steps can my clients (sellers) and i take to postpone the sale and get time to close on our escrow with the buyer? Would a ''QUALIFIED WRITTEN REQUEST, COMPLAINT, DISPUTE OF DEBT AND VALIDATION OF DEBT LETTER'' to the lender postpone the sale?
